CONSTRUCTION IN PLOTS PART OF
WHICH HAS BEEN SURRENDERED FOR ROAD DEVELOPMENT

(79) Provisions to apply as modified for construction in certain plots. 

In the case of buildings proposed in plots mentioned herein, the provisions in these rules elsewhere shall apply subject to modification in this Chapter, namely, in plots left after part of the same plot has been surrendered free of cost to a Municipality, Development Authority, Government Department or Quasi-Government Department of any facility relating to road structure. 
Provided that such road formation or road widening or junction improvement or formation or development of facility relating to road structure shall have been taken up as a project by the Municipality or Development Authority by resolution or have been sanctioned or undertaken by a Government or Quasi-Government Department or Institution or shall form part of any published or sanctioned Mater Plan or Development plan or Detailed Town Planning Scheme.

(80) Use of plot 

The Secretary may permit any use which is otherwise compatible with the use of buildings in that area, which does not adversely affect the existing trend of development and which does not cause indirect condemnation of the use in the neighboring plots of land and buildings.

(81) Coverage and floor area ration 

(1) Maximum coverage permissible shall be 80 percent for residential, special residential, mercantile or commercial, small industrial and storage occupancy; 60 percent for assembly, office and industrial occupancy, 50 percent for educational, medical or hospital and hazardous occupancy.
(2) The maximum floor area ratio permissible shall be 3 3for residential, special residential, office, mercantile or commercial, small industrial and storage occupancy; 2 for educational, medical or hospital and industrial occupancy; 1.5 fro assembly and hazardous occupancy, without any additional fee; increase in floor area on basis of additional fee shall not be allowed.

(82) Set back, height, etc 

(1) The front set back shall be 3 metres.
Provided that the width of the land surrendered may be reduced to the extent that after such deduction a minimum of 1.5 metres shall be provided as form set back. 
(2) There may not be any rear set back for buildings up to two floors from ground level.
(3) The rear set back for buildings above two floors from round level shall be minimum one metre.
(4) No part of the building shall project or encroach or hand into the neighbouring plots on the sides;
Provided that where the building has more than three floors form ground level any one of its side shall have 3 metres width, which shall be contiguous to the front yard.
(5) The Secretary may permit, if so advised by the Committee constituted under rule 85, to construct or reconstruct the wall with or without shutter(s) or door(s) on the side abutting the road wided or newly formed, on the existing portion of the building demolished for such road widening or road formation.
(6) General provision regarding distance from central line of road restriction on height with respect to width of street and front set back shall not apply to the construction under this chapter.

(83) Staircase 

Every building having more than three floors from the ground level shall have two staircases one of which may be designed as external fore escape staircase. 

(84) Parking 

The area of the land surrendered may be reduced from the area of the land required for parking to the extent that after such deduction a minimum of fifty per cent of the parking required as per these rules shall be provided. 

(85) Committee to recommend application 

(1) The Secretary shall before issuing permit submit the applications to the Committee constituted as shown below, for consideration and recommendations, namely: - 
i. Mayor or Chairperson as the case may be, of the Corporation or Municipal Council or Town Panchayat.
ii. Chairman of the Development Authority, if any constituted for the area;
iii. Town Planner of the District in the Town and Country Planning Department;
iv. Secretary of the Development Authority, if any, constituted for the area;
v. Executive Engineer, Public works Department, having jurisdiction over the area; and
vi. Head of Department or Institution, if the work is undertaken by any Government Department or Quasi-Government Department Institution.

(2) While considering the application, the meeting shall be chaired by the person, i.e., mayor, chairperson, Head of Department or Institution as the case may be, undertaking, the road formation or road widening junction improvement or formation of road facility or implementing scheme or to whom the land has been surrendered.

(3) The Secretary of the Corporation, Municipal Council Town Panchayat concerned shall be Convener of the Committee.

(4) The quorum for the meeting shall be 3 including the Convener and the Chairperson.

(5) The Committee may convene periodically as may be necessary at such pace and time as may be fixed by the Convener in consultation with the Chairperson.
