(52)
Provisions to apply as modified for certain occupancies
In the case
of certain occupancies, the provisions in these
rules shall apply subject to modifications in
this Chapter.
(53)
Residential Occupancy
- Every
floor of a flat, apartment house, lodging or
rooming house, dormitory, hostel or hotel with
residential accommodation not exceeding 150
sq. mts floor area or part thereof with a capacity
of accommodation exceeding 20 persons shall
have not less than 2 doorways as remote from
each other as practicable; such doorways shall
provide access to separate exits or may open
upon a common corridor, leading to separate
exits in opposite direction.
- No
hazardous use shall be permitted in residential
buildings or part thereof;
Provided
that hazardous use incidental to residential occupancy
may be permitted at a distance of not less than
30 metre away form any other building, if additional
fire protection measures are provided.
In
the case of buildings exceeding three storey above
ground level, a certificate of approval form the
Director of Fire fore or an officer authorised
by him shall be obtained before issue of the building
permit.
All
requirements in respect of fire protection shall
conform to part IV, Fire Protection, National
Buildings Code of India, 1983 and amendment No.
3, Part IV.
(54)
Educational, Medical or Hospital and Office or
business occupancies
- For
all plot subdivisions the total area of which
measures up to 0.4 hectres and building layouts
thereof approval shall be obtained form the
District Town Planner and for area exceeding
0.4 hectres approval shall be obtained form
the Chief Town Planner.
- The
usage of plots proposed of development or redevelopment
of land or construction of any building shall
be governed by the provisions contained in the
detailed town planning scheme or development
plan of the area;
Provided
that where no such plan exists the usage of plot
and or building shall be decided by the Secretary
- All
buildings of educational, medical or hospital
and office or business occupancy with floor
area exceeding 150 sq.m shall have minimum open
spaces as below;
(i)
In the case of educational occupancy-
Front
yard 7. Metres

(ii)
In the case of medical or hospital occupancy

Provided
that where it becomes very difficulty to provide
7.5 metres front yard due to the peculiar shape
of the plot, it shall suffice if the mean depth
is not less than 7.5 metres with minimum 5 metres
at every point.
Provided
further that where more than one building is proposed
to be constructed in one plot it shall suffice
if the open space in this sub rule are provided
from the plot boundaries with open spaces between
the two buildings therein not less than 3metres.
Provided
also that were the height of the building exceeds
10 metres the open space from the boundary in
between buildings shall be increased proportionally
at the rate of 0.5 metres fro every 3 metres increase
in height.
- Every
hospital shall be provided with incinerator
for the disposal of hazardous and pathogenic
wastes.
- All
requirements in respect of fore protection shall
conform to part IV, Fire protection, National
Building Code of India, 1983; Amendment No.
3 ands shall also be subject to any further
condition laid down by the Secretary.
- Sanitation
facilities to be provided shall be computed
at the rate of not less than 1 person per 4.75
sq.m of carpet area of the building shall be
provided in numbers not less than those stipulated
in Table 9
(55)
Assembly Occupancy
1.
For all plot subdivisions the total area
of which measures upto 0.4 hectares and buildings
layouts thereof, approval shall be obtained from
the District Town Planner and for area exceeding
0.4 hectares approval shall be obtained from the
Chief Town Planner.
2.
Every building under assembly occupancy
shall have open spaces as shown below:

4.
Clear headroom beneath or above the mezzanine
or balcony shall be not less than 3 metres.
5.
The headroom shall be not less than 2.4
metres in air-conditioned rooms.
6.
The height of storeroom, toilets. Lumber
and cellar rooms shall not be less than 2.4 metres.
7.
Balconies or galleries or mezzanines shall
be restricted to 25 percent of the total carpet
area of assembly hall area and the maximum slope
of the balcony or gallery or mezzanine shall not
exceed 35 degrees.
8.
The standard of ventilation in assembly
occupancy buildings shall be 28 cu.m fresh air
per seat per hour and shall be in accordance with
part VII Building Services, section I, Lighting
and Ventilation of National buildings Code of
India 1983.
9.
All requirements in respect of fire protection
in assembly buildings shall conform to part IV,
Fire Protection of National Building Code of India,
1983 and Amendment No. 3.
10.
In the case of cinema theatres, the location,
size and building construction shall conform to
the provisions in the Kerala Cinematography Rules,
1988 as amended from time to time and the IS 4878-9168,
Byelaws for construction of Cinema Buildings.
11.
In wedding halls where cooking and dining
facilities are provided, proper and adequate arrangements
for collection of hygienic disposal of solid and
liquid waste shall be ensured to the satisfaction
of the Secretary.
12.
Sanitation facilities to be proceed in
assembly buildings shall be computed at the rate
of not less than one person per square metre of
carpet area of the building and shall be provided
in numbers not less than those stipulated in Table
9 in rule (6) of rule 54.
(56)
Mercantile or commercial occupancy
(1)
Side yards may not be provided for building
in an area zoned exclusively for Group F1 mercantile
of commercial purpose in the development plan
or detailed town-planning scheme.
(2)
The rear yard shall be not less than 1.5
metre depth in Group F! Mercantile or commercial
building.
(3)
In the case of Group F2 mercantile or commercial
occupancy buildings front open space shall be
7.5 metres, side open space on wither side shall
be 2.0 metres and rear open space shall be 3.0
metres;
Provided
that for any building exceeding four storeys including
basement or sunken floors, the minimum width of
open space on any one side contiguous to the front
yard shall be 5 metres.
(4)
Fish or meat stalls in a public market
shall invariably be provided with a fly-proof
enclosure.
(5)
The access passage to fish or meat stall
shall have minimum width of 2 metres.
(6)
All requirements in respect of fire protection
mercantile or commercial building shall conform
to part IV, Fire protection of National Building
Code of India, 1983 and Amendment NO. 3.
(7)
Sanitation facilities to be provided shall
be as in Table 9 referred in sub-rule (6) of rule
54.
(57)
Industrial and small industrial occupancy
(1)
Location of any industry shall conform
to the provisions contained in the Kerala Factories
Rules, 1957 or any other Central or State Act
or rules or regulation in respect of industrial
location and licensing in force.
(2)
For all sub-divisions the total area of
which measures upto 0.4 hectares and buildings
layouts thereof, approval shall be obtained form
the District Town Planner and for area exceeding
0.4 hectares approval shall be obtained from the
Chief Town Planner.
(3)
The usage of plots proposed for development
or redevelopment of land or construction of any
building shall be governed by the provisions contained
in the detailed town planning scheme or development
plan for the area.
Provided
that where no such plan exists the usage of the
plot and or building shall be decided by the Secretary.
(4)
All industrial buildings with built up
area exceeding 200 square metres or where the
power used exceeds 30 HP or where the number of
workers employed exceeds 20, shall have open spaces
not less that at specified below: -

Provided
that in industrial growth centres or industrial
development areasd or any declared industrial
areas, it shall suffice, if the building has an
open pace of not less than 3 metres in all sides.
Provided that further that structures for accessory
uses may be permitted within the rear open space.
(5)
The width of every access street in any development
or redevelopment of land under industrial occupancy
shall be not less than 7 metres and shall be motorable:
Provided
that in all existing developed area other than
industrial areas where small industrial use in
permissible, the minimum width of approach to
the plot shall be not less than 3 metres.
(6)
All work rooms in buildings under industrial occupancy
shall be provided with a carpet area computed
at a rate, not less than 3.4 mts. per person employed
in such rooms, exclusive of carpet area occupied
by the machinery and breathing space of 15 cubic
metres per worker.
Provided
that the area of any workroom shall be not less
than 9.5 Sq. mts.
(7)
The minimum height of work room shall depend upon
the type of industry, the noxious gases which
might be produced or the hear generated due to
the process, the specification of room construction,
the number of workers employed in any work area
and the comfort conditions available through installation
of mechanical ventilation or air conditioning
system.
(8)
Height of office, laboratory, entrance hall, canteen,
clock room etc. shall not be less than 3 metres.
(9)
In the case of storerooms and toilets, the height
shall not be less than 2.4 metres.
(10)
Where the internal drainage system of a factory
is proposed to be connected to the public sewerage
system, prior approval of the arrangement shall
be obtained from the Pollution Control Board and
Water Authority and in such cases the internal
drainage system of a factory shall be connected
by means of a suitable trap so as to exclude volatile
or other objectionable matters.
(11)
The industrial sewage effluents, if proposed to
be discharged into nearby water bodies such as
rivers, lakes, canals, or sea, the dilution of
such waste shall be such that the water bodies
are not polluted. Such effluents shall be got
tested as to its harmlessness to the satisfaction
of the Pollution Control Board and as per the
standards prescribed by the Bureau of Indian Standards
for treatment of industrial waste and effluents.
The approval the Pollution control board shall
be obtained in all cases.
(12)
All requirements in respect of fire protection
in industrial buildings shall conform to Part
IV, Fire Protection, National Building Code of
India, 1983, amendment No. 3.
(13)
The minimum saniataion faciltied to be provided
for hazardous occupancy building shall be as described
in Table 9 given in sub rule (6) of rule 54.
(58)
Storage and warehousing Occupancy
(1)
The provisions in this rule shall apply to storage
or warehousing occupancy of area exceeding 75
sq. metres.
(2)
For all plots sub-divisions the total area of
which measures upto 0.4 hectares and building
layouts thereof approval shall be obtained form
the District Town Planner and for area exceeding
0.4 hectares approval shall be obtained from the
Chief Town Planner.
(3)
The usage of plots proposed for development or
redevelopment or construction of any building
shall be governed by the provisions contained
in the detailed town planning scheme or development
for the locality.
Provided
that where no such plan exists the usage of the
plot and or building shall be decided by the Secretary.
(4)
Every building or part thereof, designed or intended
for the handling of storage of food stuffs shall
conform to the requirements specified below:
(a)
Every building unless supported on posts shall
have continuous foundation walls extending from
at least 60 cms below ground level at least 15
cms above ground level of shall have a continuous
floor of masonry or reinforced concrete or other
quality rat-proof-material.
(b)
All openings in such foundations of floors, windows
and drains and all junctions between foundations
and walls of the building shall be effectively
rat-proofed; windows and doors shall be securely
covered with rat-proof screening or grillage or
shall be tightly closed with material sheeting,
concrete or other equally rat-proof-material.
(5)
All requirements in respect of fire protection
in storage including warehousing building shall
conform to part IV, Fire Protection, national
Building Code of India.
(6)
The minimum sanitation facilities shall be as
in Table 9 given in sub rule(6) of rule 54.
(59)
Hazardous occupancy
(1)
For all plot sub-divisions the total area
of which measures upto 0.4 hectare and building
layouts thereof approval shall be obtained form
the District Town Planner and for area exceeding
0.4 hectares approval shall be obtained from the
Chief Town Planner.
(2)
The usage of plots proposed for development or
redevelopment or construction of any building
shall be governed by the provisions contained
in the detailed town planning scheme or development
plan for the locality.
Provided
that where no such plan exists the usage of the
plot and or building shall be decided by the Secretary.
(3)
The minimum width of open yard all round the building
shall be 3 metres in the case of buildings under
Group I (1) hazardous occupancy and 10 metres
in the case of Group I (2) hazardous occupancy.
(4)
Flour mills of area upto 30 sq. metres and with
power upto 10 HP may be permitted by Secretary
in residential area and horsepower above that
may be permitted by Secretary with the permission
of the council.
(5)
Where the internal drainage system from a building
under hazardous occupancy is proposed to be connected
to the public sewerage system, prior approval
of the arrangements shall be obtained from the
Pollution Control Board and Water Authority and
in such cases the internal drainage system shall
be connected by meads of a suitable tap so as
to exclude volatile o other objectionable matters.
(6)
All requirements in respect of fire protection
in hazardous including warehousing buildings hall
conform to Part IV, Fire Protection, National
building Code of India, 1983 and amendment No.
3
(7)
The minimum sanitation facilities to be
provided in hazardous buildings shall be shown
below:
a.
At the rate of one water closet for the
first 0 males or part thereof and two water closets
for the first 50 females oar part thereof and
at the rate of one water closet for every additional
70 persons or part thereof, male or female;
b.
At the rate of one urinal for every 100
males or part thereof;
c.
At the rate of one drinking water fountain
for every 100 persons or part thereof;
d.
At the rate of one washing facility for
50 persons or part thereof; and
e.
The number of sanitation facilities like
water closet urinal, etc to be provided shall
in no case be less than as computed at the rate
of one person per every 30 sq. mts. of the gross
floor area of the building.
(8)
The Secretary shall, after considering
the width of roads, traffic generated, location
with respect to points of intersections and nearness
to occupancies of educational, assembly, mercantile,
storage and hazardous uses, in consultation with
the District Collector and chief Town Planner
decide the location of petrol filling stations
and its layout.
(9)
The location and or construction of petrol
tank and vent-pipe shall be governed by the provisions
of the Petroleum Rules, 1976.
(10)
The retail dispensing unit of a petrol
filling station shall be installed at a distance
of 10 metres from any point of the marked boundary
of its premises.
(11)
The kiosk or sales office shall have a
minimum open space of 1.5 metres from the plot
boundaries other than the front.
(12)
The location and area limits of crematoria
or burning and burial grounds including cemetery
shall be as approved by the District Collector.
(13)
There shall be minimum 10 metres open space
round the crematorium.
(14)
The Secretary shall, after considering
the access roads, traffic congestion in the locality
and in consolation with the Chief Town Planner
decide the location of the traffic terminal stations
like municipal bus stands or inter State bus terminals
and the construction of buildings shall conform
to the provisions in these rules.
(15)
The minimum sanitation facilities to be
provided for hazardous occupancy building shall
be as in Table 9 given in sub rule (6) of rule
